Terms & Conditions And Limited Warranty

1. ACCEPTANCE OF WORK

All quotations, proposals, estimates, work orders, and contracts issued by Epoxy Solutions™ are subject to these Terms & Conditions.

A signed Work Order, Proposal, Contract, or Purchase Order referencing the Work Order shall constitute acceptance of these Terms & Conditions.

2. MATERIAL PAYMENT REQUIREMENT

A non-refundable materials payment, equal to forty percent (40%) of the total contract value plus applicable HST, is required prior to scheduling and material procurement.

Materials purchased specifically for a project are custom ordered and are therefore non-refundable.

3. PAYMENT TERMS

Unless otherwise agreed in writing:

• Full and final payment is due upon completion of the project.
• Outstanding balances may be subject to interest charges of 2% per month (24% per annum).
• The Client shall be responsible for all costs, legal fees, and expenses incurred in recovering overdue amounts.

4. SITE CONDITIONS

The Owner and/or General Contractor shall:

• Provide unrestricted access to the work area.

Ensure all drains and openings are set at the correct elevation

• Ensure all equipment and obstructions are properly protected or removed prior to commencement.
• Provide adequate lighting and ventilation.
• Supply 120V single-phase power on separate circuits.
• Maintain site temperatures between 18°C and 30°C during installation and curing with relative humidity no greater than 80%.

Any delays caused by unsuitable site conditions may result in additional charges.

5. SCHEDULING AND MOBILIZATION

Pricing is based on continuous work completed in a single mobilization phase.

Projects requiring multiple mobilizations, remobilizations, return visits, or phased scheduling may be subject to additional charges.

Standard pricing applies during normal business hours. Evenings, weekends, holidays, or overtime work will be quoted separately unless specifically included.

6. MOISTURE TESTING

Epoxy Solutions™ may perform complimentary moisture testing using Tramex moisture meters. Moisture readings are valid only on the date tested.

Readings exceeding 4% moisture content or moisture vapor emissions exceeding industry standards may require additional testing, mitigation systems, or revised flooring specifications.

Advances methods of moisture vapour testing are available for a fee, and performed by a NACE certified coating Inspector. Additional costs associated with moisture mitigation shall be the responsibility of the Client.

7. SUBSTRATE CONDITIONS

All proposals are based upon visible site conditions at the time of quotation.

Hidden conditions including, but not limited to:

• Contaminated concrete
• Oil saturation
• Silicone contamination
• Existing coating failures
• Weak concrete
• Excessive moisture
• Structural deficiencies and voids under concrete

These conditions may require additional preparation and may result in additional charges.

8. CHANGES IN SCOPE

Any changes to the original scope of work requested by the Client must be approved in writing before the start and may result in revised pricing and project schedules.

No verbal changes shall be binding unless confirmed in writing by Epoxy Solutions™.

9. LIMITED WARRANTY

Epoxy Solutions™ provides a Two (2) Year Limited Written Warranty.

In order to have a full warranty, the project account must be paid in full.

This warranty applies only to flooring systems installed according to the approved specifications and maintained in accordance with manufacturer’s recommendations.

10. WARRANTY EXCLUSIONS

This warranty does not cover:

• Concrete cracking.
• Crack repair failure.
• Structural movement.
• Settlement.
• Expansion or contraction of concrete.
• Moisture vapor transmission.
• Hydrostatic pressure.
• Water intrusion
• Premature ambering
• Oil, grease, chemical contamination, or silicone contamination.
• Delamination caused by substrate conditions.
• Damage resulting from abuse, misuse, neglect, impact, or improper maintenance
• Damage caused by steel wheels, dragging equipment, pallet movement, forklifts traffic beyond design limits, or concentrated point loads
• Acts of God, flooding, fire, earthquakes, or other events beyond the control of Epoxy Solutions™

Concrete is a dynamic substrate. If concrete moves, shrinks, expands, settles, or cracks, the flooring system may be affected. Such conditions are specifically excluded from warranty coverage.

11. LIMITATION OF LIABILITY

Under no circumstances shall Epoxy Solutions™ be liable for indirect, consequential, incidental, special, or punitive damages.

The maximum liability of Epoxy Solutions™ shall not exceed the total contract value paid by the Client for the specific project.

12. OWNERSHIP OF MATERIALS

All materials supplied by Epoxy Solutions™ remain the property of Epoxy Solutions™ until full payment has been received.

13. GOVERNING LAW

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada.

14. ENTIRE AGREEMENT

These Terms & Conditions constitute the entire agreement between the parties and supersede any prior oral or written agreements relating to the project.

No modification shall be valid unless made in writing and signed by both parties.
